SMS Terms & Conditions

These SMS Terms & Conditions govern your enrollment in and use of BPA Hotshot’s SMS/MMS programs, including dispatch/load updates, appointment reminders, driver recruiting communications, service alerts, and optional marketing messages.

1) Program Description

Messaging may include quotes or booking confirmations, pickup/delivery updates, ETA/status alerts, safety notifications, account or billing notices, recruiting/application updates, and—if you opt in—promotional offers.

Messages are sent via automated technologies to the mobile number you provide. Message frequency varies. Message and data rates may apply.

2) Consent & Enrollment

You consent to receive recurring automated texts from BPA Hotshot by, for example:

Submitting a web form with your mobile number and expressly agreeing to receive texts;

Texting a designated keyword to our number;

Signing up during a phone call or in person, where the agent reads a compliant consent disclosure; or

Checking a box and submitting your number in connection with a quote, booking, or recruiting form that clearly states you agree to receive texts.

Consent is not a condition of purchase. If you do not agree, do not enroll.

3) Opt Out & Help

You may opt out at any time by replying STOP to any BPA Hotshot text. After you send STOP, we will send a one‑time confirmation text and then stop messaging the opted‑out program.

4) Costs & Carriers

Message and data rates may apply.

Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and network performance.

5) Eligibility & Responsibility

You must be the account holder or have the account holder’s permission.

You must be 18+ (or the age of majority in your jurisdiction).

Keep your contact information current; notify us if your number changes.

6) Privacy

Your information will be handled as described in our Privacy Policy (see link on our website). We do not sell or share mobile numbers, opt‑in consent, or SMS data with third parties for their own marketing or promotional purposes. Limited sharing with vendors is permitted solely to provide messaging and related support services.

7) Acceptable Use

You agree not to use our messaging programs to send unlawful, harmful, or abusive content; to harass others; or in violation of applicable laws, carrier rules, or these Terms. We may suspend or terminate enrollment for suspected misuse.

8) Disclaimers & Limitation of Liability

Messaging is provided “as is” and “as available.” We disclaim warranties to the maximum extent permitted by law. To the fullest extent permitted by law, BPA Hotshot and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or damage due to delayed/undelivered messages.

9) Changes to the Program or Terms

We may modify or terminate any messaging program or these Terms at any time. Updates will be posted on our website with the revised “Effective Date.” Your continued enrollment after changes constitutes acceptance.

10) Governing Law

These Terms are governed by the laws of the State of [insert state], without regard to conflicts of laws principles, and applicable U.S. federal law. Venue and jurisdiction shall lie in the courts located in [insert county/state].
